WHAT TOOK SO LONG?: A Federal Judge Just Axed Airline Mask Mandate as Illegal; CDC Has No Authority to Enforce Medical Mandates

A federal judge ruled this week that President Joe Biden's mask mandate on domestic air travel is illegal. 

The Trump-appointed federal judge called the mandate "unlawful" and vacated the requirement, writing, "Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the court declares unlawful and vacates the mask mandate."

This is a win for liberty-loving Americans everywhere. The CDC's requirement was unconstitutional, and now that COVID numbers are dwindling, they no longer have even the "public health" excuse.

The ruling is good, but it should never have happened. Why? Because the president should never have issued the mandate in the first place.

In our constitutional republic, the head executive should not have the power to create law. He or she should only have the power to enforce law. If Congress refuses to mandate masks on airplanes, the president can't step in with his regulatory agencies and impose that requirement.

Unfortunately, thanks to the last 100 years of judicial activism, the president has been empowered to act outside the will of Congress. He issues unconstitutional executive orders on a regular basis, and his Deep State operatives craft "regulations" that are nothing less than laws.

We the People must now rely on the good will and good judgment of the courts. We rely on the Supreme Court and lower federal courts to strike down unconstitutional mandates because many Americans don't believe they have any other recourse. In this case, the judge made the right decision. But what about the next nationwide unconstitutional mandate? Will the judge in the case vote in accordance with our founding principles?

We shouldn't have to trust the courts to maintain our constitutional republic. We must limit the president's power once and for all, and the best way to do that is by calling an Article V Convention of States.

A Convention of States is called and controlled by the states and has the power to propose constitutional amendments. These amendments can limit the president's power by outlawing executive orders, reducing the size and jurisdiction of the federal bureaucracy, and clarifying that Congress -- and only Congress -- can create laws.
